Milwaukee Comedy, Inc. – PRODUCTION RENTAL AGREEMENT
By renting space and or receiving services via Milwaukee Comedy and/or The Underground Collaborative, you are hereby entering into the following agreement:
It is agreed upon between you, the client, hereinafter referred to as the Lessee, and Milwaukee Comedy Inc. & The Underground Collaborative, hereinafter referred to as Milwaukee Comedy, that the following provisions apply to this agreement:
1 – BOX OFFICE SERVICES:
Milwaukee Comedy will provide set up and management of online ticket sales prior to the opening of the show. The Lessee must provide all relevant show information a minimum of 4 weeks prior to the start date of the production.
2 – LIABILITY/INSURANCE:
The Lessee agrees to save and hold harmless Milwaukee Comedy, Inc., The Underground Collaborative, its employees, agents and officials from and against any and all liability whatsoever arising from the Lessee’s usage of the facilities. The Lessee must bear the cost of insuring the persons attending its events against possible injury while they are on the premises. The Lessee must provide evidence of liability insurance along with the signing of this Rental Agreement. Such liability insurance must be in an amount equal to at least $1,000,000 per occurrence and must name Milwaukee Comedy, Inc., Shops of Grand Avenue and 275 W. Wisconsin Holdings LLC as an additional insured. All fire exits, hallways and doorways must be kept clear of obstruction and fire doors may not be blocked open. Fire exiting pathways must always be kept clear.
3 – EQUIPMENT/SERVICES:
Milwaukee Comedy will furnish a theatre venue with room for at least 50 patrons, utilities, front-of-house custodial support, use of lighting and sound equipment installed in the theatre, patron restrooms, online ticket sales and other services agreed upon in writing in advance. Lessee will be charged for any rental and services contracted, unusual cleaning expenses and maintenance fees.
4 – SECURITY:
Lessee will execute all security procedures as outlined by Milwaukee Comedy staff including door lock-up, final checklist and security of premises before, during and after each performance.
5 – PERSONAL PROPERTY/EQUIPMENT:
Milwaukee Comedy is not responsible for the security of Lessee’s equipment or personal property on the premises. Lessee and Lessee’s employees, agents, invitees and members assume any and all risk related to such equipment and personal property.
6 – DAMAGE TO PROPERTY/EQUIPMENT:
Lessee shall reimburse Milwaukee Comedy for any damage, cost or expense incurred in repairing or replacing any of The UC’s equipment or other property damaged by Lessee or Lessee’s employees, agents, guests or members.
7 – LOAD-IN/LOAD-OUT:
Lessee may have access to the theatre on the load-in date, day of production unless otherwise agreed upon. There is no space to store Lessee’s set, props, costumes or other equipment or materials at The UC prior to the load-in date. Sets and equipment used by Lessee for performances and personal property of Lessee’s employees must be removed from the theatre immediately after the final performance in their series, unless specific arrangements are made at least one week in advance. A check-in inspection of the theatre will be scheduled prior to load-in with a representative of the Lessee and The UC. Following strike, a check-out inspection will again be made with a representative of the Lessee and The UC to ensure the theatre is returned to the same condition prior to use by Lessee. The lobby, workshop rooms or any common area of The UC may not be used for building and painting scenery and props. Touchups to scenery are allowed in the theatre space. Set construction must be scheduled and may incur additional charges.
8- PRE-PRODUCTION MEETING:
Lessee must schedule a meeting at least one month in advance with Milwaukee Comedy’s production representative to discuss in detail its planned use of the Premises. Lessee shall provide scale scenic drawings or other staging information upon request. The plans discussed should include any and all audio-visual and lighting requirements, special effects, props, sets and any other relevant items. Lessee shall also provide the production representative with an estimate of the number of people who will attend the event and the schedule for tech rehearsals, set-up, strike and performances. The UC must approve all set pieces, outside equipment and materials.
9- ADDITIONAL CHARGES:
Lessee acknowledges receipt of Milwaukee Comedy’s fee schedule and understands that, in addition to the charges incurred prior to the production, Lessee may also be charged for additional equipment used by Lessee, erroneous cleaning needs, additional equipment or set up and additional personnel required in connection with Lessee’s use of the Premises.
10- ANTI-DISCRIMINATION POLICY:
Lessee will not unlawfully discriminate against any person with respect to race, color, religion, national origin, sex, age, physical handicap or sexual orientation and shall comply with all applicable federal, state and local laws dealing with such discrimination.
11- DRUG, ALCOHOL AND SMOKING POLICY
It is Milwaukee Comedy’s policy to prohibit “the unlawful manufacture, distribution, dispensation, possession or use of a controlled substance” on its premises. Milwaukee Comedy, The UC and the Shops of Grand Avenue are a smoke free environment. Smoking is not permitted.
12- P.R./ADVERTISING:
All public relations, ads, invitations and press releases must be provided prior to publication or mailing. Any announcements, invitations or tickets must state theatre name and location as follows:

13- ADDITIONAL CLEANING FEES:
Lessee is responsible for any additional cleaning or maintenance fees incurred due to any and all show related activities, food or beverage spillage, set materials, paint, etc.. Lessee may be charged an additional fee for any extensive or unusual cleanup, damage to persons or property or other excessive circumstances.
14 – SPECIAL CONDITIONS:
Any specially negotiated conditions must be stated in writing and will become part of the rental agreement.
15 – SIGNING DEADLINE:
This contract is void unless signed and returned to Milwaukee Comedy, accompanied by deposit and certificate of insurance if required. If Lessee cancels agreement, the deposit will be forfeited.
